The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration agreement. You and Pizza Ranch each waive the right to a jury trial and the right to participate in a class action or class arbitration.

14.3 Class Action Waiver

YOU AND PIZZA RANCH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. Unless both you and Pizza Ranch agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

14.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights or to prevent irreparable harm. Additionally, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.

14.5 Time Limitation on Claims

Any claim or cause of action arising out of or relating to these Terms or your use of the Website must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred. This limitation applies regardless of any statute of limitations to the contrary under applicable law.
